Fine for storing and depositing industrial waste

EPA Victoria has fined an earth moving company more than $7000 for depositing and storing industrial waste without an EPA license or council planning permit.

EPA officers visited the company’s site to discover a large amount of construction and demolition waste had been piling up over a number of years from various civil projects undertaken by the business. EPA Environmental Regulation Director, Liz Radcliffe said the incident served
as a reminder to businesses across the state, ”Either an EPA license is required to deposit industrial waste to land or a council planning permit is required for a materials recycling facility,” she said. “Being unaware that a license or planning permit is needed is not a good enough reason to avoid sanction. Business owners and individuals must be aware of their environmental and regulatory responsibilities.” Ms Radcliffe said the company had stopped depositing waste at the premises and EPA has issued a clean-up notice requiring the removal of the existing pile.

Acts & Regulations Pack

Update on the Guarding Guidelines

A draft of the Guarding Guideline has been prepared by David McKelvie of DMcK Management and circulated to the working group formed from the participants of the Workshop held in February 2014 for comment. Thank you to those who provided photographs.

This Guarding Guideline together with the CMPA’s Work Safely Reference Manual aims to support members in meeting the requirements of the Victorian OH&S Act 2004. In doing so, this document demonstrates a process that can be used to establish and successfully implement plant and equipment guarding specific to your site requirements.

The Guarding Guideline focuses on the guarding requirements of fixed plant and equipment in the Construction Materials Industry. The Guarding Guideline does not attempt to cover mobile equipment, site security, nor restricted or other means of access to plant and equipment or operational areas.

Members who would like an opportunity to comment on the Guideline before it is finalised should contact the CMPA Secretariat.

ERTS Forum Update

GAVIN MOREIRA, CMPA Members Services Manager attended the Earth Resources Tripartite Safety Forum met at WorkSafe in Melbourne on 23 October, 2014.The following issues were raised:

Visits to Quarries 1 July to 30 Sep 2014

There were 83 visits conducted (including dangerous goods) of these visits 29 notices were issued. Traffic Management and Plant Guarding still require the most improvement notices.

CMPA has held workshops throughout 2014 and have formed working groups with involvement from its members, safety experts and VWA to develop a Guarding Guideline and Traffic Management Guideline for the Extractives Industry.

At present there are no specific guidelines for the extractive industry in place in Victoria for Guarding or Traffic Management.

The CMPA is looking to be proactive to ensure its members’ sites are safe and to improve compliance.

Incidents at Quarries (Notifiable) June 2014 to September 2014

There were 4 notifiable incidents:

  • Contractor blown / fell off a ladder onto gate valve injuring hip – taken to hospital for examination
  • Operator cutting rusted bolt with grinder injured back of hand – taken to hospital to repair the tendon
  • Contractor fueling machine stepped on hose rolling ankle and fractured foot
  • Stone splitter on rollers pushed back over finger – taken to hospital for surgery

Quarry Project in 2015

Commencing in January 2015, VWA will be looking to reduce the number of musculoskeletal injuries on quarry sites. They will be looking to visit 25 sites over a six month period to try and reduce the number of slips, trips and falls and manual handling incidents. As well as increase employer knowledge of hazard identification processes and increase the level of compliance to safe access on site.

Update on the Traffic Management Guidelines

A draft of the Traffic Management Guideline has been prepared by David McKelvie of DMcK Management and circulated to the participants of the Workshop held in May 2014 for comment.

The Guideline is currently being finalised with a meeting held with Eric Birzulis (Landair Surveys), Ron and Charles Kerr (Conundrum Holdings), David McKelvie, Elizabeth Gibson and Gavin Moreira on 28 October 2014.

This Guideline is to establish a Traffic Management Plan together with CMPA’s Work Safely Reference Manual aims to support the requirements of the Victorian OH&S Act 2004.

In doing so, this document demonstrates how a risk management process can be used to establish and successfully implement a traffic management plan specific to your site requirements.

The purpose of the Traffic Management Plan is to:

  • Ensure the delineation of mobile equipment, road trucks, light vehicles and pedestrians so far as is reasonably practicable so that any interaction between these parties is controlled and does not result in an incident causing personal injury, property or environmental damage
  • Create a safe, effective and smooth traffic flow into and throughout the site in the most efficient and economical manner possible.

Recent Events

A meeting was held with CMPA, Members and SWIM Communications regarding re-development of the CMPA website.

Elizabeth Gibson and Gavin Moreira (CMPA) attended the opening of the new Kinder & Co premise in Braeside. In attendance was Minister for Energy and Resources, the Hon Russell Northe.

Elizabeth Gibson (CMPA) attended the Mineral and Extractive Industry Stakeholder Information Day, (DSDBI) in Melbourne.

Gavin Moreira (CMPA) attended the quarterly ERTS forum at the Victorian Workcover Authority offices in Melbourne.

Elizabeth Gibson (CMPA) attended the Extractive Industry Taskforce meeting on supply and demand of construction materials in Melbourne.

The Earth Resources Reform Steering Committee meeting on Risk Based Work Plans and Rehabilitation Bonds (DSDBI) was held, Melbourne attended by Elizabeth Gibson.

VicRoads / CCAA strategic liaison committee meeting was held in Kew attended by Elizabeth Gibson (CMPA).

Elizabeth Gibson and Gavin Moreira (CMPA) met with Voting and Associate Members to further develop the Traffic Management Guidelines.

Adrian Town and Elizabeth Gibson visited current and potential members in the Geelong and Bellarine Peninsula areas.

A meeting was held with CMPA, Voting Members and the Victorian Workcover Authority to get a better understanding of the Return to Work process and its challenges.

The CMPA Management Committee held its final meeting for the year in Kilmore.

Upcoming Events

A calendar of events, month by month has been developed to give more notice of forthcoming workshops, meetings and site visits.

On 19 February 2015 a Workshop on Safe Working Distances from Quarry Faces will be conducted to look at areas to improve safety on your quarry site.

Venue: TBC in Pakenham area

The CMPA is holding this workshop to inform members on their responsibilities with respect to safe working distances from quarry faces and to form a working group to develop guidelines specific to the industry that can be utilised by all members for their sites.

Presentations to be made by:

Victorian Workcover Authority;
Orica Australia;
Full Bore Drill and Blast;
and Atlas Copco Mining and Rock Excavation on their requirements/ perspectives related to Safe Working Distances from Quarry Faces.
