COMMERCIAL LEASE DATA ACCURATE

In a survey conducted late last year the CMPA’s analysis of the number of people operating Work Authorities under a commercial lease has also yielded accurate results.  The results of the survey highlighted the seriousness of this issue with 57% of the Work Authorities sampled operating in conjunction with a lease arrangement.  Recent data received from the DPI has yielded similar figures.

The CMPA intends to use the information to promote to WA holders the potential consequences of not entering a stable/fair lease contract under Section 21.2.b of the Extractive Industry Development Act.  Further to this the CMPA will also use the information to address the removal of section 21.2.b. from the Act during its review in 2004.

Evaluation by external lawyers has shown that section 21.2.b is irrelevant and is not conducive to the equitable operation of Extractive Industry Work Authorities.  This issue was recently raised with the Minister at an Extractive and Mining Industry Advisory Board meeting in Melbourne.
