OUTSTANDING EMIAB (Extractive Mining Industry Advisory Board) ISSUES.
Bond Issue.
The second draft has been presented to our patron, Professor Ross Williams and our management committee for their comment, and further information has been sought by the CMPA and the DNRE for inclusion in his calculation before the final draft is presented.
Once it is bound the CMPA will present the report to the Minister with a covering letter defining its position. During the process of developing this Bond Report members of the CMPA have established communication channels with numerous Parliamentarians, Industry Advisors and other Associations experiencing similar bond issues. This report will highlight the flaws of the present bond assessment mechanism and offer alternative methods of managing the governments perceived liability.
For members interest a summary of the reports findings will be published in a future issue of CMPA News.
Work Authorities dependance on the land holder consent.
As a result of a members concern at Meeting 6, the Association presented a submission to the EIMAB on 16th March 2001, entitled “Relationship to W A’s and PP’S involving commercial leases”. We would like to thank Jack Kraan and Michael Gerner of KLM Gerner Consulting, and Robin Hocking from Ham and Murray for their wisdom in developing an understanding of this issue.
We were asked to
provide statistical information on the number of Work Authorities issued in
connection with a commercial lease as an action from that meeting. This
information is being collated between the CMPA and the DNRE and once available
will enhance the government and Associations’ understanding of the issue. For
further insight please read the feature article under Section 6 of this issue
prepared by Andrew Lumb of Nevitt Ford Lawyers to whom we are deeply indebted.
